“Restrained interpretation” refers to the theory of constitutional interpretation where courts interpret the Constitution as closely as possible to its text, historical context, and the intent behind its drafting, while minimizing judicial creation of new principles or rights.
“Expansive interpretation,” on the other hand, refers to the theory that courts should interpret the Constitution dynamically and adaptively, allowing judges to actively reshape or expand constitutional meaning in response to modern social, political, and moral developments.
